Terms of Use

2media GmbH, with its registered office in Zurich (hereinafter the “Provider”), operates this internet website (hereinafter the “Website”). These Terms of Use govern the rights and obligations of the Provider and the users of the Website (hereinafter collectively the “Users”) with respect to the use of the Website and all services provided by the Provider in connection with the Website.
1. Offer and Use
1.1. On the Website, the Provider publishes information relating to taxes as well as financial and insurance products, in particular service and price comparisons (hereinafter collectively the “Information”), connects Users with qualified experts (referrals) who independently provide subsequent tax services and/or advice and brokerage of financial and insurance products, and sends information to Users via email newsletters (collectively the “Offer”).
1.2. The Offer does not constitute an invitation or recommendation to purchase or otherwise obtain any service or product. The Offer is non-binding for Users. The Provider does not itself provide tax services, advice or brokerage services for financial or insurance products, and does not act as a contracting party between Users and referred service providers or advisors. The Offer is addressed exclusively to natural persons with full legal capacity who are domiciled in Switzerland. The Offer is made available to such persons free of charge and without obligation for private use only. Any use by other natural persons, by legal entities, or for commercial purposes is prohibited. To the extent permitted by law, Users waive any potential claims of their own to commissions or other remuneration arising from tax services, advice or brokerage provided by third parties, whether payable to third parties or to the Provider, in connection with the Offer.
1.3. The Provider is entitled at any time to assign or transfer individual or all rights and obligations arising in connection with the Offer to third parties in Switzerland or abroad.
2. Quality
2.1. The Provider endeavours to ensure a high quality of the Offer. Despite careful review, the Provider gives no direct or indirect warranty or assurance regarding the quality, accuracy, completeness or timeliness of the Information or newsletters provided.
2.2. Users are obliged to provide only accurate and complete information and data to the Provider in order to enable a high quality of the Offer. Users who provide incorrect or incomplete data are fully liable for any direct or indirect damage incurred by the Provider as a result.
2.3. Third parties and their partners whose tax services as well as advice and brokerage are referred to Users by the Provider are required to perform their services at all times with the highest level of professional competence and due care, and to fully comply with applicable Swiss law as well as all relevant professional, provider-specific and industry-specific recommendations, guidelines and other applicable rules. The Provider assumes no liability for the qualifications, integrity or services of referred tax service providers or advisors. Any contracts are concluded exclusively between Users and the respective advisors or service providers.

3. Warranty and Liability
3.1. The Provider operates the Website professionally and with due care. Nevertheless, the Website may be temporarily unavailable in whole or in part, in particular for technical reasons or due to maintenance work. The Provider provides no warranties with respect to functions or services in connection with the Website. Use of the Website is at the Users’ own risk.
3.2. The Provider shall be liable exclusively for direct damage caused by its own gross negligence or wilful misconduct.
- Any further liability of the Provider is excluded, in particular for:
- direct damage resulting from slight or medium negligence;
- indirect damage, consequential damage or loss of profit of any kind;
- incorrect, incomplete or outdated information;
- damage in connection with referred tax service providers, advisors or their services;
- damage caused by technical disruptions, viruses or communication errors;
- damage resulting from the content of third-party websites linked on the Website.
3.3. The Provider shall also not be liable if obligations arising from these Terms of Use are performed only partially or not at all due to force majeure. Force majeure includes, in particular, attacks and explosions, riots, wars and civil unrest, fires and lightning strikes, floods and other natural disasters, epidemics and pandemics, IT security incidents, nuclear accidents, restrictions or interruptions of electricity or other energy supplies, interruptions of telecommunications services, strikes, magnetic storms, unforeseeable weather conditions, and government-imposed prohibitions. The consequences of SARS-CoV-2 are expressly deemed to constitute force majeure.
3.4. The limitation of liability under these Terms of Use applies irrespective of the legal basis of the claim. Any mandatory statutory liability that cannot be excluded remains reserved.
4. Data Protection
4.1. General information on the processing of personal data and on the rights of individuals whose data is processed in connection with the Website can be found in the Provider’s Privacy Policy. Where and insofar as the Provider operates the Website on behalf of a client, the data protection notices on the respective client’s website shall also apply. The Provider collects and processes the data necessary to operate the Offer on its own behalf or on behalf of a client.
4.2. The Provider is subject to Swiss data protection law and generally stores personal data and other data on infrastructure located in Switzerland. The Provider collects and processes in particular data that Users submit (or cause to be submitted) directly via forms on the Website, via apps connected to the Website, or by other means. Such data may include, for example, names, contact details, dates of birth, gender, family relationships, information on newsletter usage, and preferences relating to advice and brokerage. Additional data such as date and time stamps, IP addresses used, operating systems and browsers, and location data may also be generated through use of the Website.
4.3. The Provider may process all collected data for all purposes related to operating the Website and providing the Offer, including for information, marketing, market research, risk assessment and referral purposes. Data may be retained for as long as required for the relevant purpose(s), but at least for ten (10) years. The Provider implements appropriate technical and organisational measures to ensure a level of data security appropriate to the risk.
4.4. Users who receive Information and referred tax services, advice or brokerage via the Website expressly consent to the transfer of the data collected and processed for this purpose to third parties, in particular tax service providers, advisors and brokers. This consent also applies to sensitive personal data and to data subject to professional confidentiality obligations. Tax service providers, advisors and brokers are required to fully comply with Swiss data protection law at all times.
4.5 Users who receive Information and referred tax services, advice or brokerage via the Website also expressly agree to receive information from the Provider via email newsletters and other electronic communication channels. Data collected and processed by the Provider for newsletter distribution may also be used in connection with other websites operated by the Provider, in particular for newsletter distribution via such other websites and the offers presented there. Users may object to newsletter distribution at any time.

5. Final Provisions
5.1. By using the Website, Users acknowledge and accept these Terms of Use. The Provider may amend these Terms of Use at any time without stating reasons. The version published on the Website at any given time shall apply. Amendments become effective upon first use of the modified Website. Users who continue to use the Website after publication of the amended Terms of Use are deemed to have accepted them. If a User does not agree with an amendment, the right to use the Website ends upon publication of the new Terms of Use. Users are responsible for reviewing the Terms of Use regularly.
5.2. Should any provision of these Terms of Use be or become unenforceable, invalid or ineffective, the enforceability, validity and effectiveness of the remaining provisions shall not be affected. In such case, the parties shall replace the unenforceable, invalid or ineffective provision with a provision that is enforceable, valid and effective and that most closely reflects the original intent of the parties in legal and economic terms.
5.3. Use of the Website and these Terms of Use are governed exclusively by Swiss law, with exclusive place of performance and jurisdiction at the Provider’s registered office. This does not apply to disputes arising from consumer contracts, where consumers may also bring claims at their place of residence. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
